RODO

This clause includes information on the processing of personal data by Marineworks S.A., entered in the Register of Entrepreneurs of the National Court Register under KRS: 0000956059, NIP: 5842814680, REGON: 521366568, in a fully or partially automated manner and in a manner other than automated manner of personal data constituting or intended to constitute part of a data set, required by the Regulation of the European Parliament and of the Council (EU) 2016/679 of April 27, 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (General Data Protection Regulation), hereinafter referred to as “RODO”. The clause is addressed to natural persons who are contractors or potential contractors of the Entrepreneur, representatives, employees or contact persons of certain entities or other types of stakeholders and correspondents of the Entrepreneur.

I. Personal data controller

II. Processing of personal data of “representatives” (including, but not limited to, employees, persons representing an entity/person, including attorneys, persons designated to contact or provide information or perform specific tasks) of the following entities:

  • contractors or potential contractors of the Entrepreneur,
  • organizational units, legal/physical persons or other types of entities cooperating with the Entrepreneur on a basis other than a contract,
  • entities from the Entrepreneur’s business environment,
  • other types of entities contacting the Entrepreneur on any matter,
  • personal data of persons who are correspondents in their own case, other than current or potential contractors.

1. If you are a “representative” or a person referred to in this Section II above, we process your personal data on the basis of Article 6(1)(c) of the RODO, in order to fulfill legal obligations, or on the basis of Article 6(1)(f) of the RODO, i.e. for purposes arising from our legitimate interests in conducting our business, which include, depending on the circumstances of the case:

  • communication and correspondence handling,
  • to establish, or maintain contacts relating to the subject matter of the Entrepreneur,

  • to present an offer, or to consider an offer received or otherwise establish cooperation,
  • related to the implementation of the contract concluded with the contractor,
  • document circulation,
  • to perform the required actions before the competent authorities, including public administration,
  • establish or assert possible claims, or defend against such claims.

2. If we have not obtained personal data directly from you, it comes from the entity for which you act or a party to the contract concluded with the Entrepreneur, or from publicly available registers/databases, including the National Court Register, the Central Register and Information on Economic Activity, the Public Information Bulletin or websites.

If we obtain the data by means other than directly from you, we may process the following categories of personal data: basic identification data, including your name, identification data granted by public authorities, electronic identification and location data, address data, contact data (e-mail address, telephone number), data on the place of employment and position or function held, professional rights held, or other data provided to the Entrepreneur in connection with cooperation or contact.

3. We will keep personal data processed on the basis of the legitimate interest of the Entrepreneur until it ceases to exist, and in particular for the time necessary to secure the information in case of a legal need to prove facts or until the expiration of the statute of limitations for potential claims.

4. Recipients of the data may be:

  • persons authorized by us to process data in the performance of their official duties,
  • other entities, if necessary, so that we can fulfill our obligations under the concluded contracts or the law, including the proper performance of the service, or exercise our rights,
  • postal and courier service providers, banks, insurers, tax advisors, law firms,
  • entities to which we have outsourced personal data processing services,
  • courts and public authorities to which the Entrepreneur is obliged or authorized to make your data available.

5. You have the right to access your personal data, the right to request rectification and completion of your personal data, the right to request erasure of your personal data, in the cases indicated in Article 17 of the RODO, the right to request restriction of processing of your personal data, in the cases indicated in Article 18 of the RODO, the right to transfer your personal data that we process by automated means on the basis of a contract or consent, the right to object, and the right to lodge a complaint to the supervisory authority in charge of personal data protection, i.e. the President of the Office for Personal Data Protection.

6. You have the right to object to the processing of your data for purposes arising from our legitimate interests.

7. Provision of data is voluntary, but necessary for the purpose for which the data are processed. In some cases, the provision of personal data is a statutory or contractual requirement.

8. There will be no automated decision-making, including profiling, in the processing of your data.

9. We do not transfer your data outside the EU/European Economic Area.

III. Processing of personal data of individuals who are contractors or potential contractors

1. If you are our contractor or potential contractor, we process your personal data on the basis of Article 6(1)(b) RODO for the purpose of entering into a contract and performing pre-contractual activities, such as negotiations, exchange of documents, or for the purpose of executing the contract, or on the basis of Article 6(1)(c) RODO for the purpose of performing obligations prescribed by law, including taxation. (c) RODO in order to comply with legal obligations, including tax obligations, or under Article 6(1)(f) RODO for purposes arising from our legitimate interests in operating our business and conducting our business, and in particular, depending on the circumstances of the case, for purposes of:

  • communication and correspondence handling,
  • to establish, or maintain contacts relating to the subject matter of the Entrepreneur,
  • to present an offer, or to consider an offer received or otherwise establish cooperation,

  • to conclude a contract and to perform pre-contractual activities, such as negotiations, exchange of documents,
  • document circulation,

  • establish or assert possible claims, or defend against such claims.

If we did not obtain your data directly from you, the data comes from publicly available registers/databases, including the National Court Register, the Central Register and Information on Economic Activity, the Public Information Bulletin or websites. If we obtain the data by means other than directly from you, we may process the following categories of your personal data: basic identification data, including your name and surname, identification data granted by public authorities, financial identification data, electronic identification and location data, address data, contact data (e-mail address, telephone number), data on your professional rights, or other data provided to us in connection with cooperation or contact.

3. your data obtained for the purpose of concluding and performing a contract, we will store until the end of the statute of limitations for any claims arising therefrom, data processed in our legitimate interest until it ceases, and in particular for the time necessary to secure information in the event of a legal need to prove the facts or until the statute of limitations for any claims, and data processed for the purpose of fulfilling a legal obligation for the period prescribed by law.

4. Recipients of the data may be:

  • persons authorized by us to process data in the performance of their official duties,
  • other entities, if necessary, so that we can fulfill our obligations under the concluded contracts or the law, including the proper performance of the service, or exercise our rights,
  • entities providing, among others, postal and courier services, banks, insurers, tax advisors, law firms,
  • entities to which we have outsourced personal data processing services,
